1. WHAT INFORMATION DO WE COLLECT?

In Short: We collect personal information that you provide to us.

We collect personal information that you voluntarily provide to us when you express an interest in obtaining information about us or our products and Services, when you participate in activities on the Services, or otherwise when you contact us.

  • citizenship and previous citizenship information

  • Danish CPR numbers and Danish immigration identification numbers, where applicable

  • information and documentation concerning your legal entry into and stay in Denmark or the Schengen Area

  • information about previous marriages or civil partnerships and how they ended

  • information and documentation concerning children you have together, including names, dates of birth, citizenship and birth certificates

  • information about your relationship, including how you met, whether and where you have lived together, and supporting documentation concerning shared residence

  • information concerning previous stays in Denmark

  • marriage preferences and information required to arrange and coordinate your marriage ceremony

  • declarations, powers of attorney, signatures and other documents required in connection with your marriage application

  • other information or documentation that you choose to provide or that may reasonably be required to assess, prepare, submit or manage your marriage application.

Sensitive and highly confidential information. Our marriage application services may require us to process identity documents, identification numbers, civil-status records and other personal documents containing highly confidential personal information. In some cases, documents voluntarily provided to us may also contain special categories of personal data. Where such information is processed, we will only process it where there is an appropriate legal basis and where necessary for the relevant purpose.

Information about your partner or other individuals. If you provide personal information or documents relating to your partner, children or any other individual, you must ensure that you are authorised to provide that information to us and, where required, that the individual has been informed about our processing of their personal data and this Privacy Notice.

Information automatically collected

In Short: Some information — such as your Internet Protocol (IP) address and/or browser and device characteristics — is collected automatically when you visit our Services.

We automatically collect certain information when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device and usage information, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. This information is primarily needed to maintain the security and operation of our Services, and for our internal analytics and reporting purposes.

Like many businesses, we also collect information through cookies and similar technologies.

The information we collect includes:

  • Log and Usage Data. Log and usage data is service-related, diagnostic, usage, and performance information our servers automatically collect when you access or use our Services and which we record in log files. Depending on how you interact with us, this log data may include your IP address, device information, browser type, and settings and information about your activity in the Services (such as the date/time stamps associated with your usage, pages and files viewed, searches, and other actions you take such as which features you use), device event information (such as system activity, error reports (sometimes called 'crash dumps' ), and hardware settings).

  • Device Data. We collect device data such as information about your computer, phone, tablet, or other device you use to access the Services. Depending on the device used, this device data may include information such as your IP address (or proxy server), device and application identification numbers, location, browser type, hardware model, Internet service provider and/or mobile carrier, operating system, and system configuration information.

2. HOW DO WE PROCESS YOUR INFORMATION?

In Short: We process your information to provide, administer and improve our Services, communicate with you, comply with legal obligations, protect our rights and, where applicable, for other purposes with your consent.

We process your personal information for the following purposes:

  • To provide and administer our Services. We process personal information as necessary to provide the services you request from us and to perform our contractual obligations.

  • To assess and prepare marriage applications. Where you use our marriage application services, we process the information and documents you provide to assess documentation requirements, prepare your application and identify any additional information or documents that may be required.

  • To submit and manage marriage applications. Where authorised by you, we process and transmit personal information and documents in order to submit and manage your marriage application and communicate with the relevant Danish authorities and other parties involved in the marriage process.

  • To arrange and coordinate marriage ceremonies. We process information necessary to request, arrange and coordinate ceremony dates and related services with the relevant municipality, ceremony venue and other parties involved in providing the Services.

  • To communicate with you. We may process your contact details and other relevant information to respond to enquiries, provide updates, request additional information or documents and otherwise communicate with you regarding our Services.

  • To manage our business relationship with you. This includes administration, customer service, invoicing, accounting and maintaining appropriate business records.

  • To comply with legal obligations. We may process personal information where necessary to comply with applicable laws, regulations, legal processes or requests from competent authorities.

  • To protect our rights and prevent misuse. We may process information where reasonably necessary to protect our business, enforce our agreements, establish or defend legal claims, prevent fraud or misuse of our Services, and maintain the security of our Services.

  • For other purposes with your consent. Where required by law, we may process your personal information for additional purposes with your consent. You may withdraw your consent in accordance with applicable law.

3. WHAT LEGAL BASES DO WE RELY ON TO PROCESS YOUR INFORMATION?

In Short: We only process your personal information where we have a valid legal basis to do so under applicable data protection law. The legal basis depends on the purpose for which we process your information.

If you are located in the EU or UK, we may rely on the following legal bases:

  • Performance of a Contract. We process personal information where it is necessary to provide the Services you have requested, to fulfil our contractual obligations to you, or to take steps at your request before entering into a contract. This includes, where applicable, assessing and preparing your marriage application, reviewing the information and documents you provide, communicating with you about your application, submitting and managing your application where authorised by you, and arranging or coordinating your marriage ceremony and related Services.

  • Legal Obligations. We may process personal information where necessary to comply with legal obligations that apply to us, including applicable accounting, tax, regulatory, record-keeping and other legal requirements.

  • Legitimate Interests. We may process personal information where necessary for our legitimate interests or those of a third party, provided that those interests are not overridden by your interests, rights or freedoms. Depending on the circumstances, these interests may include operating and securing our Services, preventing fraud or misuse, maintaining appropriate business records, improving our Services, responding to and managing legal claims, and protecting our legal rights.

  • Consent. Where we rely on your consent for a specific processing activity, we will ask for that consent separately where required. You may withdraw your consent at any time. Withdrawal of consent does not affect the lawfulness of processing carried out before the withdrawal.

  • Vital Interests. In exceptional circumstances, we may process personal information where necessary to protect your vital interests or the vital interests of another person.

 We may process your information if you have given us specific permission (i.e. express consent) to use your personal information for a specific purpose, or in situations where your permission can be inferred (i.e. implied consent). You can withdraw your consent at any time.

In some exceptional cases, we may be legally permitted under applicable law to process your information without your consent, including, for example:

  • If collection is clearly in the interests of an individual and consent cannot be obtained in a timely way

  • For investigations and fraud detection and prevention

  • For business transactions provided certain conditions are met

  • If it is contained in a witness statement and the collection is necessary to assess, process, or settle an insurance claim

  • For identifying injured, ill, or deceased persons and communicating with next of kin

  • If we have reasonable grounds to believe an individual has been, is, or may be victim of financial abuse

  • If it is reasonable to expect collection and use with consent would compromise the availability or the accuracy of the information and the collection is reasonable for purposes related to investigating a breach of an agreement or a contravention of the laws of Canada or a province

  • If disclosure is required to comply with a subpoena, warrant, court order, or rules of the court relating to the production of records

  • If it was produced by an individual in the course of their employment, business, or profession and the collection is consistent with the purposes for which the information was produced

  • If the collection is solely for journalistic, artistic, or literary purposes

  • If the information is publicly available and is specified by the regulations

  • We may disclose de-identified information for approved research or statistics projects, subject to ethics oversight and confidentiality commitments

4. WHEN AND WITH WHOM DO WE SHARE YOUR PERSONAL INFORMATION?

In Short: We may share personal information where necessary to provide our Services, manage your marriage application, comply with legal obligations, or work with service providers that support our business.

We may share your personal information with the following categories of recipients:

  • Danish authorities and public bodies. Where necessary to provide our marriage application services and where authorised by you, we may share your personal information and documents with the Danish Agency of Family Law (Familieretshuset), municipalities and other competent Danish authorities or public bodies involved in processing your marriage application or arranging your marriage ceremony.

  • Municipalities and ceremony providers. We may share information necessary to arrange and coordinate your marriage ceremony with the relevant municipality, town hall, ceremony venue or other parties involved in providing or coordinating the ceremony.

  • Vendors and Service Providers. We use third-party service providers to support the operation of our Services. This includes providers of online forms and document collection, email and communication services, website hosting, analytics, payment processing, accounting and other business-support services. In particular, personal information and documents submitted through our online application forms may be processed through our form provider and subsequently transferred to our business email system and secure local storage for the purpose of reviewing and managing your marriage application.

    Where these service providers process personal information on our behalf, we take appropriate steps to ensure that the processing is subject to suitable contractual and data protection safeguards. Where personal information is transferred outside the European Economic Area, we use appropriate safeguards as required by applicable data protection law.

  • Professional Advisers. Where necessary, we may share personal information with professional advisers such as accountants, lawyers or other consultants for legitimate business, legal, accounting or compliance purposes.

  • Business Transfers. We may share or transfer personal information in connection with, or during negotiations relating to, a merger, sale of company assets, financing, restructuring or acquisition of all or part of our business.

In Short: We may use cookies and similar technologies to operate, secure and improve our website and, where you have provided your consent, for analytics and advertising purposes.

We use cookies and similar technologies for purposes such as maintaining the functionality and security of our website, remembering your preferences, understanding how visitors use our website, and measuring the effectiveness of our website and marketing activities.

Some cookies and similar technologies are strictly necessary for our website to function and may be used without your consent where permitted by law. Other technologies, including certain analytics and advertising technologies, will only be used where required consent has been obtained.

Google Analytics. We use Google Analytics to help us understand how visitors use our website and to measure and improve the performance of our Services. 6. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep personal information only for as long as necessary for the purposes described in this Privacy Notice or as required by applicable law.

The retention period depends on the type of information and the purpose for which it is processed.

Marriage application documents. Personal information and documents collected specifically for the preparation, submission and management of your marriage application, such as copies of identity documents, civil-status documents, residence documentation, declarations and powers of attorney, will generally be deleted within 12 months after completion of our marriage services, unless continued retention is necessary for a specific legal, administrative or contractual reason.

Business and accounting records. Certain information relating to our contractual relationship, payments, invoices and accounting records may be retained for longer periods where required by applicable tax, accounting or other legal obligations.

Legal claims and disputes. Where a dispute, complaint or legal claim exists, we may retain information that is reasonably necessary for the establishment, exercise or defence of legal claims for as long as the relevant matter requires.

When personal information is no longer required for the purposes for which it was collected and we have no other lawful reason to retain it, we will delete or anonymise it. Where immediate deletion is not technically possible, for example because information is contained in backup systems, we will restrict further processing until deletion is possible.

7. HOW DO WE KEEP YOUR INFORMATION SAFE?

In Short: We use appropriate technical and organisational measures designed to protect the personal information we process.

We take reasonable and appropriate technical and organisational measures to protect personal information against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access.

The measures we apply are selected taking into account the nature and sensitivity of the personal information we process, the purposes of the processing, the risks to individuals, and the technologies and service providers involved.

Access to personal information and documents is limited to persons and service providers who require access for the relevant business purpose and who are subject to appropriate confidentiality and data protection obligations.

Where we use third-party service providers to process personal information on our behalf, we take appropriate steps to ensure that suitable data protection and security safeguards are in place.

However, no method of electronic transmission or storage can be guaranteed to be completely secure. While we take appropriate measures to protect your personal information, you are also responsible for using secure means when communicating information to us and for protecting any account or access credentials under your control.

8. DO WE COLLECT INFORMATION FROM MINORS?

In Short: Our Services are intended for adults. However, in connection with our marriage services, we may need to process limited personal information and documents relating to children of our clients.

Our Services are not directed to children under the age of 18, and we do not knowingly offer our Services directly to children.

Where necessary for the preparation, assessment, submission or management of a marriage application, we may process personal information relating to children of our clients. This may include information such as a child’s name, date of birth, citizenship and birth certificate.

Such information is provided to us by the adults using our Services and will only be processed where relevant and necessary for the provision of our Services or where otherwise permitted or required by applicable law.

We do not use personal information relating to children for advertising, profiling or marketing purposes.

If you believe that we have received personal information relating to a child that is not necessary for our Services or has been provided to us improperly, please contact us using the details provided in this Privacy Notice.

9. WHAT ARE YOUR PRIVACY RIGHTS?

In Short: Depending on where you live, applicable data protection laws may give you certain rights regarding your personal information.

If you are located in the European Economic Area (EEA), United Kingdom, Switzerland, Canada, or another jurisdiction providing similar rights, you may have the right, subject to applicable law, to:

• request access to the personal information we process about you and obtain a copy of that information;
• request correction of inaccurate or incomplete personal information;
• request deletion of your personal information;
• request restriction of the processing of your personal information;

Withdrawing your consent. Where we rely on your consent as the legal basis for a specific processing activity, you may withdraw that consent at any time. Withdrawal will not affect the lawfulness of processing carried out before the withdrawal or processing based on another lawful basis.

Marketing communications. You can unsubscribe from marketing and promotional emails at any time by using the unsubscribe link included in those communications or by contacting us. You may still receive service-related communications necessary for the provision and administration of our Services.

Cookies and similar technologies. You can manage your cookie preferences through the cookie settings available on our website. You may also be able to control or delete cookies through your browser settings.

How to exercise your rights. To exercise your privacy rights, please contact us using the contact details provided in the section “HOW CAN YOU CONTACT US ABOUT THIS NOTICE?” below. We may need to verify your identity before responding to a request.

We will respond to requests in accordance with applicable data protection law.

If you are located in the EEA and believe that our processing of your personal information infringes applicable data protection law, you also have the right to lodge a complaint with a competent data protection supervisory authority. As Ærø Moments is established in Denmark, you may contact the Danish Data Protection Agency (Datatilsynet).

10. CONTROLS FOR DO-NOT-TRACK FEATURES

Some web browsers and devices provide “Do Not Track” (“DNT”) signals or similar privacy preference mechanisms. Because there is currently no universally accepted standard for how DNT signals should be interpreted, our website does not currently respond to DNT signals unless we are required to do so by applicable law.

This does not affect your ability to manage cookies and similar technologies through the cookie settings available on our website. Where your consent is required for analytics, advertising or other non-essential tracking technologies, your choices made through our cookie settings will apply.

Will your information be shared with anyone else?

We do not sell personal information for monetary consideration.

We also use Google Analytics and Google advertising services to measure website usage and the performance of our advertising campaigns. Where required by applicable law, these technologies are used only in accordance with your cookie and privacy choices.

  • Right to limit use and disclosure of sensitive personal data (as permitted by applicable law, including the privacy law in California)

  • Right to opt out of the collection of sensitive data and personal data collected through the operation of a voice or facial recognition feature (as permitted by applicable law, including the privacy law in Florida)

How to Exercise Your Rights

To exercise these rights, you can contact us by submitting a data subject access request, by emailing us at hej@aeroemoments.dk, or by referring to the contact details at the bottom of this document. 

Under certain US state data protection laws, you can designate an authorised agent to make a request on your behalf. We may deny a request from an authorised agent that does not submit proof that they have been validly authorised to act on your behalf in accordance with applicable laws.

Request Verification

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. We will only use personal information provided in your request to verify your identity or authority to make the request. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes.

If you submit the request through an authorised agent, we may need to collect additional information to verify your identity before processing your request and the agent will need to provide a written and signed permission from you to submit such request on your behalf.

Appeals

Under certain US state data protection laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at hej@aeroemoments.dk. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.

California 'Shine The Light' Law

California Civil Code Section 1798.83, also known as the 'Shine The Light' law, permits our users who are California residents to request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. If you are a California resident and would like to make such a request, please submit your request in writing to us by using the contact details provided in the section 'HOW CAN YOU CONTACT US ABOUT THIS NOTICE?'

12. DO WE MAKE UPDATES TO THIS NOTICE?

In Short: Yes, we will update this notice as necessary to stay compliant with relevant laws.

We may update this Privacy Notice from time to time. The updated version will be indicated by an updated “Revised” date at the top of this Privacy Notice. If we make material changes to this Privacy Notice, we may notify you by prominently posting a notice of the changes or by directly sending you a notification.
